Defense Verdict from the United States District Court for the District of Maryland

Charles “Chad” I. Joseph obtained a defense verdict for a board certified family medicine physician in a wrongful death case.  The case was tried in the United States District Court for the District of Maryland (Baltimore).  Plaintiffs claimed that our client’s decision not to perform an EKG was unreasonable, and that this decision caused the decedent’s death.  We introduced evidence that the standards of care did not require an EKG, and even if performed, the EKG would have been normal.  The jury deliberated almost three hours before returning a defense verdict.
